Terms of Use
These Terms of Use ("Terms") apply to the WeatherFlo website, mobile application, and related services. WeatherFlo is operated by Capexfly. By using WeatherFlo, you agree to these Terms. If you do not agree, do not use the website or application.
1. Eligibility
You must be at least the age of majority in your jurisdiction, or use WeatherFlo under the supervision of a parent or guardian where permitted by law.
2. License and Permitted Use
Subject to these Terms, Capexfly grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use WeatherFlo for personal, non-commercial purposes. WeatherFlo is licensed, not sold.
3. Intellectual Property
All content, trademarks, software, design, text, graphics, visual media, weather-matched videos, and other materials in WeatherFlo are owned by or licensed to Capexfly. Unauthorised copying, modification, distribution, or commercial exploitation is prohibited.
4. Acceptable Use
You agree not to use WeatherFlo in violation of law, attempt unauthorised access, interfere with performance or security, scrape or abuse requests, copy content beyond permitted personal use, bypass technical limits, or use a compromised device in ways that create security risk.
5. Weather Information and Informational Use
Weather information and related content are for general informational purposes only. WeatherFlo is not intended for emergency, safety-critical, aviation, maritime, medical, legal, financial, or other high-risk decisions. Always verify important conditions with official sources.
6. Location and Manual Search
Location access is optional. Manual search does not require GPS but requires an internet connection. You are responsible for ensuring any selected location is appropriate for your intended use.
7. Automated Weather-Matched Visuals
Automated visual experiences are intended to make weather easier to understand. They are not official warnings, emergency alerts, or professional advice. WeatherFlo does not make decisions with legal, medical, financial, or safety-critical effects.
8. Connectivity and Device Responsibility
Some features require an active internet connection. You are responsible for data charges, device charge, updates, and security.
9. Third-Party Services and Links
WeatherFlo may rely on third-party services including Cloudflare, Supabase, OpenWeather, Apple, and others. Capexfly does not control third-party services and is not responsible for their content, availability, or practices.
10. Privacy
Your use of WeatherFlo is subject to our Privacy Policy.
11. Apple App Store Terms
If you download WeatherFlo from the Apple App Store, your use is also subject to Apple's applicable terms. Apple is not responsible for maintenance or support for WeatherFlo.
12. Updates, Changes, and Availability
Capexfly may update, modify, suspend, or discontinue any part of WeatherFlo. WeatherFlo is currently provided as a free service. Paid features, if introduced, will be clearly communicated before you are charged.
13. Termination
Capexfly may suspend or terminate access if you violate these Terms, misuse the service, create risk, or where required by law. You may stop using WeatherFlo at any time by deleting the app.
14. Disclaimers
WeatherFlo is provided "as is" and "as available." To the maximum extent permitted by law, Capexfly disclaims all warranties including accuracy, availability, merchantability, and fitness for a particular purpose.
15. Limitation of Liability
To the maximum extent permitted by law, Capexfly is not liable for indirect, incidental, consequential, or punitive damages arising from your use of WeatherFlo. Total liability will not exceed the greater of amounts you paid in the 12 months before the claim or USD 50, except where liability cannot be excluded by law.
16. Indemnification
You agree to indemnify Capexfly from claims arising from your breach of these Terms, misuse, violation of law, or infringement of others' rights.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa, excluding conflict-of-law principles.
18. Dispute Resolution and Venue
Disputes will be brought exclusively in the courts located in Johannesburg, South Africa, unless applicable law requires otherwise.
19. Changes to These Terms
We may update these Terms from time to time. Continued use after updated Terms are posted means you accept the updated Terms, where permitted by law.
